What protections exist for employees with disabilities in the state of California?

California has several laws that provide protections for employees with disabilities. These laws include:

  • The California Fair Employment and Housing Act (FEHA): This law prohibits discrimination in employment based on a disability. It applies to employers with five or more employees and covers all aspects of employment, including hiring, promotions, pay, and working conditions.
  • The California Disabled Persons Act (CDPA): This law prohibits discrimination against people with disabilities in places of public accommodation and service. It applies to all employers, regardless of size.
  • The California Family Rights Act (CFRA): This law provides eligible employees with up to 12 weeks of unpaid leave per year for certain family and medical reasons, including the care of a disabled family member.
  • The California Pregnancy Disability Leave Law (PDLL): This law requires employers with five or more employees to provide up to four months of unpaid leave to employees who are disabled due to pregnancy, childbirth, or related medical conditions.
  • The California Workforce Development, Disability, and Paid Family Leave Benefits Law: This law provides disability insurance benefits and paid family leave benefits to eligible employees.

All these laws apply in California, and any employer covered under these laws should comply with all of the rules and regulations. It is also important to note that some of the laws like FEHA, CDPA and CFRA has similar but stronger standards compared to the federal law ADA.
